Looks like the EFF just won a big battle over the DMCA & fair use.

EFF Wins New Legal Protections for Video Artists, Cell Phone Jailbreakers, and Unlockers

It is now legal to jailbreak your phones and use third party apps not approved by the manufacturer, as well as unlock a phone for use on a new carrier.

Fair use of movies and videos is now also A-ok!

A step in the right direction!

I guess there's a separate ruling being issued in a court case about DRM:

http://www.courthousenews.com/2010/07/23/29099.htm

They're both really positive developments, but it's a little confusing because they have similar implications, but are coming from different places--one the court system and the other the Copyright Office and Library of Congress.

I had heard about the court case before, but my understanding is that the ruling is clearer now and has broader implications than some people thought before.

I wonder if this could shoot HDCP in the foot... In many cases it prevents people from viewing the movie(s) they purchased.

HDCP should only affect the connection between the player and the TV. As long as your player is HCDP, and your TV is as well there shouldn't be any issues, right?

You run into problems when trying to watch something on a non-HDCP compliant monitor/TV. Thus you aren't able to view a movie that you paid for. Why should the end user be forced to upgrade to HDCP compliant equipment in order to enjoy something they have legitimately purchased?

It's a waste of time as well. It's all designed for copyright protection (High-bandwidth Digital Content Protection) but it's been bypassed already and quite easily.

I'm realizing now that your post may have been sarcastic....

Hmm. It is sort of the same thing. It's an extension of DRM from the media player. The idea is that not only do they want to override your ability to play the media you own, but they want to prevent you from copying it from the output.

It's different but the same.

In any event, I really hope all this stuff ends all this DRM madness.
